Conditions for the use of our services.

1. Scope

These terms of service govern the use of services provided by blogsandpages.com (“we”, “us”, “our”), operated by Katharina Schneider, Hauptstraße 129/C, 61440 Oberursel, Germany, by our contract clients (“Client”, “you”). They apply in addition to individual contracts or order confirmations.

2. Description of Services

We provide services around WordPress themes, custom publishing, migration and content operations. In addition, we operate a Pinterest publishing service at the subdomain pinterest.blogsandpages.com, which posts pins on the Client’s Pinterest account on the Client’s behalf (“Pinterest Service”). Content, frequency and target boards of the pins are agreed separately by contract.

3. Client Obligations

Authorization: For the Pinterest Service, the Client provides a Pinterest Business account with the necessary permissions and grants us technical access through the official Pinterest OAuth authorization flow.

Third-party rights: The Client warrants that the content provided for publication (images, text, links, trademarks) does not infringe any third-party rights — in particular copyright, trademark, personal and competition rights.

Community guidelines: The Client ensures that the content provided does not violate Pinterest’s Terms of Service or Community Guidelines.

Cooperation: The Client provides the necessary content in due time and in usable quality. Delays attributable to the Client extend our delivery timeline accordingly.

4. Provider Obligations

We commit in particular to:

  • confidential treatment of the OAuth refresh token and all account-related data,
  • publishing pins according to the separately agreed specifications,
  • compliance with the Pinterest API Terms of Service and Community Guidelines,
  • secure technical operation on servers in Germany (Goneo Internet GmbH, Hanover).

5. License Grant

By granting the OAuth authorization, the Client grants us the non-exclusive right, limited to the duration of the service relationship, to technically store, process and publish the provided content via the Pinterest API on the Client’s Pinterest account. Rights in the content itself remain with the Client.

6. Remuneration

Remuneration is set out in the individual contract or order confirmation. Invoices are payable upon receipt without deduction unless otherwise agreed. VAT is charged in accordance with applicable statutory rules.

7. Withdrawal and Termination

The Client can revoke the Pinterest connection at any time at pinterest.com/settings/apps, which effectively terminates the technical service delivery via the Pinterest API.

Independently of this, either party may terminate the underlying service relationship in accordance with the notice periods agreed in the individual contract.

8. Liability

We are liable without limitation for intent and gross negligence as well as for damages resulting from injury to life, body or health. In cases of ordinary negligence, we are only liable for breach of material contractual obligations (cardinal obligations) and limited to the foreseeable damage typical for this type of contract.

Liability for indirect damages, lost revenue, reach losses, suspensions or sanctions by Pinterest or third parties is — to the extent permitted by law — excluded.

9. Availability

We provide technical availability on a best-effort basis but do not guarantee permanent availability of the Pinterest API, individual pins or specific reach. Algorithmic decisions, suspensions or content moderation by Pinterest are outside our control.

10. Data Protection

11. Governing Law and Jurisdiction

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If the Client is a merchant, a legal entity under public law or a public-law special fund, the place of jurisdiction is the provider’s registered office. The place of performance is also the provider’s registered office.

12. Severability

Should individual provisions of these terms be or become invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by a provision that most closely reflects the economic intent.
